These are the Terms of Service for GinChat.
GinChat – Terms of Service
Article 1 (General Provisions)
- All persons who use this service (including browsing, posting, answering, etc.; without limitation) (“Users”) shall use the service only after reading, understanding, and agreeing to these Terms.
- By using the service, Users are deemed to have agreed to comply with all provisions of these Terms.
- We may change these Terms at any time without prior notice or additional procedures, and the revised Terms shall apply from the time of change.
- Depending on the content and type of the service, we may establish operational rules (local rules) for each service item. If such rules conflict with these Terms, the operational rules shall prevail.
Article 2 (Purpose)
- This service is established and operated by us as a place for Users to consult and exchange opinions. Users shall browse, post, and answer on this service with an understanding of this purpose.
Article 3 (Prohibited Acts)
- The following acts are prohibited on this service:
- 1. Posting URLs other than the ginchat.jp domain.
- 2. Posting content that deviates from the themes or information specified for each category.
- 3. Posting the same content repeatedly, or posting meaningless strings of characters (multi-spam posting).
- 4. Posts seeking encounters or posts intended for compensated dating.
- 5. Infringing the honor, social credit, privacy, portrait rights, publicity rights, copyrights or other intellectual property rights, or other rights of others (including all rights recognized by laws and case law).
- 6. Posting real names, addresses, email addresses, or phone numbers (except for publicly available information or public figures).
- 7. Linking to harmful computer programs or similar content.
- 8. Interfering with or disrupting this service, or servers or networks connected to this service.
- 9. Content that can be construed as a notice of crime, inducement to suicide, or other content that threatens or intimidates others.
- 10. Religious activities including promotion of religion, establishment/activities of religious organizations, or joining religious organizations.
- 11. Fraud, coercion, pyramid schemes, or other illegal transactions, or solicitation for such transactions.
- 12. Solicitation to possess or use items or substances regulated under laws such as the Narcotics and Psychotropics Control Act and the Firearms and Swords Control Act.
- 13. Any other matters prohibited by the laws and regulations of Japan.
- 14. Any other acts deemed inappropriate by the administrator.
- If we discover a violation of any of the matters described in items 1 through 13 above, we may take measures we deem necessary, including deleting or editing the relevant post/answer and refusing access by the relevant user.
- If a user engages in prohibited acts and we incur damages as a result, we will claim compensation for such damages.
Article 4 (Our Authority)
- In operating this service, we have the following authority. This article sets forth our rights, and we do not have any obligation to carry out the items below or to respond to deletion/correction requests from users. We shall not be liable for any damages arising from the exercise of our rights under this article.
- 1. The right to delete or edit posts/answers without obtaining the consent of the poster/answerer, and the right to take measures such as refusing access.
- 2. The right to decide all matters regarding display methods, categories, posting periods, etc., and the right to reclassify information, merge categories, or move information posted/answered in inappropriate categories.
- 3. The right to take measures we deem necessary, including reporting to investigative authorities, for the benefit of third parties harmed by violations.
- 4. The right to suspend or terminate this service without prior notice or consent from users.
Article 5 (Handling of Personal Information)
- The basis of our personal information protection policy for this service is the Act on the Protection of Personal Information (Act No. 57; the “APPI”).
- We comply with the APPI and, in principle, do not provide users’ personal information (including post/answer log information) to third parties. However, we may disclose users’ personal information in the following cases:
- 1. When we receive a request for disclosure of logs from a police station or court in connection with an inquiry based on Article 197, Paragraph 2 of the Code of Criminal Procedure.
- 2. When we receive a judgment or order from a court to disclose information under the Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Sender Information (the Provider Liability Limitation Act).
- 3. When a user engages in conduct that violates these Terms despite repeated warnings from us.
- 4. When we discover that a user has posted, or engaged in conduct equivalent to posting, real names, addresses, email addresses, phone numbers, or similar information.
- 5. When a user engages in conduct that is disadvantageous to us.
- 6. Other cases recognized as exceptions under the APPI.
- We do not provide users’ personal information in response to requests under Article 23-2 of the Attorney Act.
Article 6 (Copyright and Intellectual Property Rights)
- All information posted on this service is our copyrighted work, and copyrights belong to us under the Copyright Act. However, this does not apply to quotations of news, citations/sources, emoticons, ASCII art, etc.
- Posters/answerers post at their own responsibility and agree that all responsibility arising from their posts/answers belongs to them.
- Users agree that intellectual property rights (including the rights stipulated in Articles 21 through 28 of the Copyright Act) contained in their posts/answers are transferred to us free of charge.
Article 7 (Disclaimers)
- We assume no responsibility for troubles between users or any unforeseen damages.
- We do not charge usage fees for this service. We also assume no responsibility for any unforeseen damages arising therefrom.
- Posts/answers are posted at the responsibility of the poster/answerer, and we have no obligation to guarantee their truthfulness, legality, safety, appropriateness, usefulness, etc.
- We do not guarantee the absence of any content or expression that violates prohibited acts, and we shall not be liable for any damages arising therefrom (including mental distress, business interruption, or any other monetary loss).
- We shall not be liable for any damages arising from inability to use this service or statements made by third parties on this service.
Article 8 (Governing Law and Jurisdiction)
- If a dispute arises between us and a user regarding this service or these Terms, we and the user shall discuss in good faith.
- If the dispute cannot be resolved through discussion, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
- These Terms shall be governed by the laws of Japan.
